Terms of service
The agreement between your company and MLJ, SASU for the use of the RainDelayLog daily site log and delay documentation service.
In force since March 2, 2026. These terms apply to every RainDelayLog account. Read them before you subscribe, because they describe what the service does, what it costs, and where responsibility sits.
1. Acceptance
By creating an account, subscribing to a plan or using RainDelayLog on behalf of a company, you accept these terms and confirm that you are authorized to bind that company. If you do not accept them, do not use the service. The person who accepts on behalf of a general contractor, construction manager or subcontractor is treated as that company's representative for the purposes of this agreement.
2. What the service is
RainDelayLog is a hosted daily site log for commercial construction projects. It binds each job to a public National Weather Service reporting station or to an on site gauge you designate, archives hourly observations, applies the threshold rules you configure per activity type, records field entries with photographs and crew information, tracks contractual notice deadlines, and exports delay documentation packets in PDF and CSV format. The service also offers optional synchronization with third party construction platforms and schedule tools.
RainDelayLog is a documentation tool. It is not a law firm, a claims consultancy, an engineering practice or a scheduling authority. Nothing produced by the service constitutes legal advice, and no packet guarantees that an owner, architect, construction manager, arbitrator or court will grant a time extension. Decisions about notice, entitlement and claim strategy remain yours.
3. Accounts and eligibility
The service is sold to businesses only and is not offered to consumers. You must be at least eighteen years old and legally capable of entering into a contract. You are responsible for the accuracy of your account details, for keeping credentials confidential, for the activity of every user you invite, and for removing access when someone leaves your company. 4. Acceptable use
You agree not to use RainDelayLog to store unlawful content, to falsify a record, to submit a photograph or field entry you know to be inaccurate, to attempt to access another customer's data, to probe or overload the infrastructure, to resell access to the service without a written agreement, or to reverse engineer the software. Records created inside the service are intended to be relied upon by third parties, so deliberate falsification is a material breach and grounds for immediate termination without refund.
5. Subscription and billing
Plans are billed monthly in United States dollars and renew automatically until cancelled. Single Site costs $59 per month and covers one active job site. Multi Site costs $149 per month and covers up to ten active job sites. Enterprise Site costs $349 per month and covers an unlimited number of active job sites, together with single sign on, API access and the claim support described on the pricing section of the home page.
Pricing is per company and per active job site, not per user, and every person on a covered job may log entries at no extra charge. A job stops counting toward your active total on the day you archive it. If your active job count exceeds the ceiling of your plan, the plan moves up at the start of the next billing period and you are notified before that happens. Prices are exclusive of any sales tax, VAT or withholding that may apply in your jurisdiction. Price changes are announced at least thirty days in advance and never apply to a period already paid.
6. Cancellation and suspension
You may cancel at any time from the account screen. There is no term commitment and no exit fee. Cancellation takes effect at the end of the paid month, the account stays readable through that period, and exports remain available while it is open. Fees already paid are not refunded for a partial month, except where the law of your state requires otherwise. We may suspend an account for non payment after written notice, or immediately for a serious breach of section 4, and we will always allow a reasonable window to export your records before any deletion.
7. Your data
Field entries, photographs, signatures, threshold rules and exported packets belong to your company. MLJ, SASU processes them only to provide the service, to support you and to keep the platform secure and reliable. We do not sell customer data, we do not use your project records to advertise to you, and we do not disclose them to a third party except where you instruct it or where a binding legal order requires it. You can export a full archive of any job in PDF and CSV at any time without asking us. Archived records are retained for seven years after a job closes so that a late claim can still be defended, and earlier deletion is carried out on written request.
8. Availability and support
We target 99.5 percent monthly availability outside announced maintenance windows, which are scheduled at United States overnight hours whenever possible. Weather data is retrieved from public reporting stations and their availability is outside our control, so a station outage may delay an automatic capture until the record is republished. Support is provided by email during French business hours, and Enterprise Site customers receive a four hour response commitment during those hours.
9. Warranty disclaimer
The service is provided on an as is and as available basis. To the fullest extent permitted by law, MLJ, SASU disclaims all implied warranties including merchantability, fitness for a particular purpose and non infringement. We do not warrant that the service will be uninterrupted or error free, that third party weather data will be complete for every hour of every day, or that any specific claim outcome will follow from using the product.
10. Limitation of liability
To the fullest extent permitted by law, the total liability of MLJ, SASU under this agreement for any claim is limited to the amount you paid for the service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, including lost profit, lost contract, liquidated damages assessed against you, schedule impact or the rejection of a delay claim by a third party. Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnity
You agree to indemnify MLJ, SASU against third party claims arising from your use of the service in breach of these terms, from content you upload, or from your reliance on a delay packet in a dispute where the underlying field record was inaccurate or incomplete.
12. Changes to these terms
We may update these terms as the product changes. Material changes are announced by email to account holders at least thirty days before they take effect, and the date at the top of this page is updated. Continuing to use the service after that date means you accept the revised terms. If you do not accept them, cancel before the effective date and the prior version governs your final billing period.
13. Governing law and contact
These terms are governed by French law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the competent courts of Paris, France, without prejudice to mandatory protections available to you locally. The contracting entity is MLJ, SASU, publisher of RainDelayLog, whose registration details appear on the legal notice.
